The City of Mesa is hiring for an Assistant City Prosecutor I.

Description/Duties

Salary Range and Growth Potential: It is anticipated that an entry-level prosector will start at a salary around $103,000. The salary range for this Assistant City Prosecutor I position is $80,196 - $118,687 annually, with the potential to advance by noncompetitive promotion to Assistant City Prosecutor II ($88,397 - $130,824 annually) and to Assistant City Prosecutor III ($102,353 - $151,478 annually) upon meeting specific criteria-based promotion requirements.

This recruitment will used to fill one vacancy, as well as establish an eligible list to fill possible future vacancies. First review of applications will be Monday, March 24, 2025, and weekly thereafter.

This classification has been designated as a non-classified, non-merit system, at-will position.

An Assistant City Prosecutor I performs entry-level, professional legal work in the preparation and prosecution of cases in municipal court. An attorney in this class is given an extensive orientation in criminal prosecution activities and the various components of the criminal justice system. Responsibilities include: negotiating cases and plea agreements; conducting bench and jury trials; presenting motions, pleadings, and arguments in court; and interviewing witnesses, Police Officers, victims, and others. This class is also responsible for performing some appellate work and related duties as required.

This classification has been designated as a non-classified, non-merit system, at-will position. This class is distinguished from the next higher-level classification, Assistant City Prosecutor II, by the latter's increased responsibilities and greater degree of legal and administrative knowledge and expertise. Employees in this class may progress by noncompetitive promotion to Assistant City Prosecutor II upon meeting the specific criteria-based promotion requirements. This class is supervised by a Deputy City Prosecutor who reviews work closely during initial training; however, incumbents may receive functional supervision from an Assistant City Prosecutor II or an Assistant City Prosecutor III on a special project basis. However, incumbents are eventually expected to handle trial work independently and under more general supervision. This class is FLSA exempt-professional. (Part-time employees in this class are FLSA nonexempt).

Job Duties:  While the position's working title is "Condemnation Attorney", the attorney will actually provide legal services and advice to the Department of Transportation on a wide variety of issues as assigned.

The attorney will be responsible for handling all phases of complex litigation involving real property acquisition and construction contract disputes.

Additional matters will include, but are not limited to, relocation issues, encroachments and other right-of-way issues, interpretation of any statutory intergovernmental agreements, interagency service agreements, property management issues, interpretation of any statutory of regulatory provisions relevant to ADOT activities, and review of proposed legislation or administrative rules.

The attorney may also be asked to provide legal advice and representation on a variety of topics to ADOT's Motor Vehicle Division, Aeronautics Division, and various statutorily created boards and commissions.

Represents the City of Tucson's interests in legal proceedings, to include administrative hearings as well as litigation in state and federal courts

 

DUTIES AND RESPONSIBILITIES:*

General Description of Position

 

The City Attorney is looking for an attorney to practice in the Civil Division of the Office. The attorneys in the Civil Division are assigned to various practice areas as Office needs may change or arise over time.  Those practice areas could range from administrative law to zoning; and examples include construction of public works; constitutional law; contracts and intergovernmental agreements; economic development; elections; eminent domain; employment law (Title VII, Arizona Civil Rights Act, FLSA, ADA, ADEA, FMLA, etc.); environmental law; municipal finance and taxation; open meetings and public records; procurement; public utilities and telecom; real estate; water law; land use/zoning and more. While the currently anticipated practice areas for this position include real estate and land use, given the range of practice areas within the Civil Division the City Attorney will consider applicants whose prior experience may not include experience in the currently anticipated practice areas of need. The City Attorney may choose to hire more than one candidate from this recruitment.

 

Position Specific Summary

 

The Principal Assistant City Attorney position in the Civil Division of the Tucson City Attorney’s Office provides advanced-level legal services and performs advanced-level legal work in assigned areas of practiceAttorneys at this level work with a high level of autonomy and accountability. Provides guidance and mentoring to lower-level attorney personnel.

 

Work is performed in accordance with general policies and established standards of the legal profession and is reviewed by the City Attorney or their designee. This position does not supervise.

 

Duties and Responsibilities

  • Responds to legal inquiries from the City’s executive management team and their staff, typically for assigned City departments. Identifies, analyzes and explains legal issues associated with projects and programs of City-wide importance. Performs advanced-level professional and administrative legal work including development of and revisions to the Tucson Code. Consults with client decision makers regarding departmental and major legal issues. Provides legal advice and assistance.

 

  • Prepares and reviews materials submitted to the Mayor and Council for its consideration and approval for legal issues. Prepares ordinances or resolutions for consideration by the Mayor and Council. Analyzes legal issues associated with initiatives under consideration by the City Manager or Mayor and Council. Consults with Mayor and Council and City management at public meetings and in executive sessions as needed. Guides and mentors lower-level attorneys.

 

  • Reviews and prepares a variety of legal documents including but not limited to contracts, intergovernmental agreements, legal correspondence, notices and position statements.

 

  • Litigates complex legal matters (in administrative matters; or in federal or state courts) in assigned area of practice, and/or supports litigation efforts in those matters by performing research, preparing and filing pleadings, making court appearances, etc.

 

  • Serves as litigator for the City in State and Federal Courts. Identifies, analyzes, and discusses legal issues associated with projects. Handles legal matters of assigned departments and acts as liaison with departments, the City Manager, and the Mayor and Council.

ABOUT THIS POSITION

The City of Phoenix Law Department is comprised of two sections, the City Attorney's Office, which handles representing the City in civil matters, and the City Prosecutor's Office, which handles the prosecution of misdemeanor crimes committed in Phoenix. Assistant City Attorneys in the Civil Division of the Law Department work in one of six areas: Public Safety, Litigation, Transportation, Human Resources, City Services, and Community Development.

 

The Civil Division is seeking an Assistant City Attorney IV to provide legal services to the Public Transit Department. The Public Transit Department is a provider of comprehensive transit services in the Phoenix area, the owner of multiple transit facilities and stations, and serves as the regional Designated Recipient for the Federal Transit Administration (FTA). 

 

This role will advise on interesting and varied issues, including issues associated with bus service, light rail, paratransit services, intergovernmental agreements with other cities and Valley Metro, municipal procurement (including Title 34 procurement), real estate matters, federal grants, federal regulatory compliance, and applicable public bodies at public meetings. We are currently seeking a talented, motivated and solution-focused regulatory attorney for a mid-level to senior federal regulatory attorney position. The successful candidate will perform legal services required by TEP and its affiliated companies (collectively “Company”). The Company’s service territory is in Arizona and the successful candidate must be a Tucson, Arizona resident or willing to move to Tucson.

Position Description and Related Responsibilities

Specific responsibilities include, but are not limited to, the following:

  • Serves as federal regulatory counsel, providing advice and counsel to all levels of management and multiple corporate client groups primarily on matters subject to federal utility regulation.
  • Monitors new rulemaking and policies and performs research and analysis of the Company’s factual and legal position regarding various regulatory and related matters.
  • Analyzes applicable law and supports the development of strategies to mitigate risk and comply with existing and potential regulation in areas including supporting the Company’s participation in regulatory and legal proceedings.

The path-breaking Clinical Program of the Sandra Day O'Connor College of Law at Arizona State University seeks applications for a  full-time Clinical Associate/Professor of Law position at the rank of Associate/Full Instructional Professional as the Director of the Civil Litigation Clinic. One of the earliest clinics in the nation, the Civil Litigation Clinic, has addressed a broad range of topics over the years. The clinic's mission is to train law students to become effective, compassionate practitioners through direct representation of clients in litigation that is closely supervised by the Clinical Associate/Professor of Law. The clinic also provides classroom instruction and individual mentoring. In fulfilling its mission to educate students to become effective practitioners, the clinic strives to promote access to justice by offering free legal services to people who do not have adequate resources to hire a private attorney. The Civil Litigation Clinic is one of ten legal clinics in the Law School's Clinical Program. INTERDISCIPLINARY GENERAL ENGINEER-PHYSICAL SCIENTIST

 

The Office of Environmental Management (EM) is responsible for the safe cleanup of the environmental legacy resulting from five decades of nuclear weapons development and government-sponsored nuclear energy research. The EM work is being done in 11 states and the lifecycle cost of the program is currently estimated to be over 330 billion dollars and will span beyond 2075.

 

This position functions as the CBFO Federal Project Director (FPD) with responsibility for monitoring, technical direction, and reporting on technical, programmatic, regulatory, environment, safety and health, (ES&H) and fiscal execution of Capital Asset Project(s) (CAPs), General Plant Project(s) (GPPs), and other projects at WIPP.

As the CBFO Federal Project Director you will:

  • Evaluate project execution(s) from the standpoint of public/personnel health and safety, quality assurance, environmental protection, project management principles, and consistency with project plans and milestones.
  • Evaluate project control systems, identifying vulnerabilities, and coordinating with line management during corrective action to minimize/mitigate vulnerabilities.
  • Review effectiveness of contractor management control capabilities to successfully execute WIPP project work scopes: Review all aspects of contract control procedures and systems to determine whether those procedures and systems satisfy contractual requirements for successful execution of WIPP projects. Advise senior level management on acceptability of management control procedures and systems associated with successful execution of WIPP projects. Coordinate with
    DOE headquarters and participates in development of both short-term compensatory measures and ultimate solutions for the WIPP key projects. Generate written evaluations identifying inadequacies or weaknesses and report to senior management, while coordinating project concerns with WIPP site line management.
  • Participate in meetings with contractors and project sponsors to assure adherence to quality assurance, environmental health and safety requirements, schedules, budgets, and designs associated with the WIPP projects.
  • Participate in Inspector General investigations and other special reviews of WIPP projects by providing information, testimony and facilitating access to other federal or contractor staff during the investigation.
  • Serve as a Contracting Officer Representative on one or more CBFO-managed contracts as necessary to successfully execute the WIPP projects. Reviews invoices, fee requests, cost reports or other financial data associated with the WIPP projects and makes recommendations for approval.
  • Train and mentor Technical Monitors and other technical oversight staff to ensure comprehensive oversight of all assigned functional areas associated with the WIPP projects.

Job Description

The Associate General Counsel is responsible for providing a high level of professional legal service by representing and advising the Arizona Board of Regents and Arizona State University on a broad range of education law and other legal matters.

This position will be within the employment practice group, which concentrates primarily on academic and non-academic personnel matters, student matters, and law enforcement matters. Attorneys in this group provide advice and counsel on public records requests; policies and procedures; academic integrity; student conduct; residency appeals, including related administrative hearings; constitutional, legislative and regulatory matters (First Amendment, FERPA, Title IX, discrimination and harassment, Clery, VAWA, financial aid and student visas); admissions and scholarships; and federal and state employment and administrative law matters, such as at-will employment, law enforcement personnel, discipline, termination and grievances, compensation and employee benefits, immigration, discrimination and civil rights matters involving employees, conflict of interest, and independent contractors.
