CROSS PRACTICE: When Your Client Doesn’t Fit the Mold

How to get it right ethically, legally and procedurally when your client’s communication, presentation or delivery are compromised.

As more people from other countries and cultures move to Arizona in the aftermath of a pandemic, we will each serve clients who face cultural, language, mental health and other barriers to accessing justice.No matter what your area of practice, most of us will engage a client who doesn’t quite “fit the mold.”In every area of practice, and at every stage of service, there are opportunities to overcome obstacles for a successful outcome in cross-culture practice.

  • Does your client speak English?
  • Is your client from a different culture?
  • Does your client require a translator?
  • Is your client facing severe health challenges? .
  • Does your client have a mental health challenge?
  • Does your client have addiction allegations?

Effective representation starts with managing client expectations, navigating translation and cultural challenges, and screening for mental health challenges. Some of your client’s weaknesses could be the greatest strengths of your case.

Jennifer Moshier has practiced law in Arizona since 2006 and in California since 2001. Moshier Law was founded in 2009 with the vision of giving clients greater self-determination and the goal of bringing collaborative law to Arizona despite substantial litigation experience. Jennifer graduated from Pepperdine University School of Law and received her Bachelor of Arts from Arizona State University.

Trail Potter attended law school in Houston, Texas, graduating from the South Texas College of Law, and moving to Arizona in 2013. After a year working at the Department of Child Safety while awaiting his law license, Trail began practicing family law, juvenile law and personal injury. He has argued several cases before the Arizona Court of Appeals. Trail also volunteers with veteran's advocacy groups and high school mock trial tournaments.
